Simunomics Rules of Play

1. As the CEO of your company, you have almost complete control. You can choose your buildings, products, partners, prices, and locations. However, you have a board of directors to answer to, and they expect every move you make to be in the company's best interest, and to expect all other businesses to be the same way.
   
   Therefore, every trade must be beneficial to BOTH parties. Gifts, starter funds, loans, sweetheart deals, and every other unbalanced trade is disallowed. You can give discounts to trading partners, but the price must be within a reasonable range of the market price, and must be high enough that you are making a profit on it. The system may provide a warning if it detects a price to another player that is unreasonably high or low. But don't rely on this warning and DO NOT try to figure out exactly where the "cutoff" is.
   
   If a trade is determined to be willfully violating this rule, both players will lose their CEO positions. (i.e. your account will be locked/deleted).
2. To help your company get started, each player begins with a supply of money and supplies. For this and other reasons, we must insist on one account per person. This is strictly monitored, including but not limited to checking IPs.
   
   If two roommates, relatives, or other people wish to share a connection, there are two options:
   • Avoid any interaction with each other, with no buying or selling between you.
   • Each of you upgrades to a Gold account, and registers the relationship in the game. If you do this, you can trade with each other, but remember that rule one must still be followed regarding all trades.
   Exceptions may be made on a case-by-case basis with moderator permission. To apply, use in-game feedback to request an exception and wait for a response. Account restrictions will apply.
3. No real-word company or brand names are allowed. Use of trademarked or copyrighted terms infringes on the rights of the owners and can create legal problems. For this reason, a mandatory name change will be forced on any company breaking this rule. For continued infractions, the account may be locked.
4. No offensive, pornographic, copyright-infringing, or otherwise inappropriate material is allowed in any capacity. This includes publicly viewable statements and private messages.
5. "Bots" or automated scripts are not allowed.
6. No outside links are allowed, unless they are Simunomics-related (e.g. a Trade Group website).
7. If found, exploits must be reported to Simunomics staff immediately. This includes anything that bypasses normal game procedures. Players found to be in willful violation of this rule will be subject to account lock and IP ban.
8. Accounts are non-transferrable. Assets contained in the game can not be exchanged for anything of value externally.
9. Do not impersonate other persons, including members or Simunomics staff, by name or self-representation.
10. The Simunomics staff is not responsible for content created by individuals or third parties. However, if inappropriate material is reported the staff will make an effort to deal with it.
11. The decisions of the Simunomics staff are final. No refunds are given for any services or virtual goods purchased.

Simunomics Terms of Use

PLEASE READ THE FOLLOWING TERMS, CONDITIONS, POLICIES, AND NOTICES CAREFULLY AND IN THEIR ENTIRETY. THIS LICENSE DESCRIBES THE TERMS ON WHICH SIMUNOMICS OFFERS YOU ACCESS TO AN ACCOUNT TO PLAY THE GAME. These Terms of Use apply to each visitor and user of the site (collectively "Users"), including registered and unregistered, paid subscribers and free trial users. By visiting or using this site you agree to these Terms of Use. The purchase of additional services may be subject to additional terms and conditions.

Unless stated otherwise, Simunomics may change these Terms of Use at any time. You are responsible for abiding by the terms of service and separate Game Rules on each and every visit.

Simunomics Description

Simunomics is a multi-user online game service that allows you to play the game in most common JavaScript-enabled browsers. In the game, you will create a library of licensed digital objects that depict physical objects such as land, buildings, employees, inventory, and currency, and you will obtain a limited license for the right to use such representations within the game. You will not acquire any ownership interest in the digital objects.

Account Eligibility

The Account is personal to you and may not be transferred, sold or used by anyone else. The Game and Game Service are intended for individuals eighteen (18) years of age and older. If you are between the ages of thirteen (13) and eighteen (18), the parent's permission is required during signup. If under thirteen (13) your parent or guardian must complete the registration process for you. For any users under eighteen (18), the parent or guardian will take full responsibility for all obligations under this license and will be liable for all activities conducted through the Account. You are subject to all laws of the state, province, and/or country in which you reside and from which you access Simunomics, and you are solely responsible for obeying those laws.

Currency and property

Simunomics currency ("βucks" a.k.a. "Bucks" as well as "Tickets") and "assets" are a limited license right available for purchase or free distribution at Simunomics.com discretion, and are not redeemable for monetary value. You acknowledge that the service includes a component of in-world fictional currency which may be used for the likewise acquisition of in-world fictional goods and services. Regardless of terminology used, βucks and the virtual properties purchased with them represent a limited license right governed solely under the terms of this agreement, and are not redeemable for any real currency or property at any conversion rate. You agree that Simunomics has the absolute right to manage, regulate, control, modify and/or eliminate such currency or goods as it sees fit in its sole discretion, in any general or specific case, and that Simunomics will have no liability to you based on its exercise of such right.

Simunomics includes a component through which real currency can be exchanged for the limited license known as "Tickets", which can themselves be exchanged for a similar license for βucks or for in-game fictional products or services. This exchange of fees for game services is one-direction only, and is regulated at Simunomics sole discretion. In-game assets, including but not limited to βucks, Tickets, Buildings, Lands, Employees, and virtual goods, have no real-world value and cannot be transferred from the player for real currency.

User content

By submitting any text, images, designs, video, sound, code, data, lists, or other materials or information (referred to herein as "User Content") you hereby irrevocably grant to Simunomics, its affiliates and sub licensees, a worldwide, perpetual, irrevocable, royalty-free, non-exclusive, and fully sub-licensable license, to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such User Content (in whole or in part) in any media and to incorporate the User Content into other works in any format or medium now known or later developed. The foregoing grants shall include the right to exploit any proprietary rights in such User Content, including but not limited to rights under copyright, trademark, service mark or patent laws under any relevant jurisdiction.

You represent and warrant that: (i) you own or control all of the rights to the User Content that you post or you otherwise have the right to post such User Content to the Site, (ii) the User Content is accurate and not misleading, and (iii) use and posting of the User Content you supply does not violate these Terms of Use and will not violate any rights of or cause injury to any person or entity, including without limitation the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any User Content posted by you to or through the Site.

You are solely responsible for the User Content that you post, store or upload on or through the Site, including any material or information that you transmit to other Users. Simunomics reserves the right, but does not have an obligation, to delete, screen, or edit any User Content posted, stored, uploaded, or linked on the site at any time and for any reason without notice.

Limits on Use of the Site

You agree not to engage in any of the following: (i) use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, data scrape, copy or transfer any part of the Site (including without limitation any User data, including any Member registration information, whether individually or in the aggregate); (ii) probe, scan or test the vulnerability of the Site, or breach the security or authentication measures on the Site; (iii) reverse look-up, trace or seek to trace any information on any Member or other User of the Site, including information on any Member account other than your own, to its source, or exploit the Site in any way with a purpose of revealing any information, including but not limited to personal identification or information, other than your own information; (iv) take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site; (v) use any device, software or routine to interfere or attempt to interfere with the proper working or authorized uses of the Site or with any other person's use of the Site; (vi) forge headers or otherwise manipulate identifiers in order to disguise the origin of any message transmittal you send on or through the Site; (vii) impersonate any other individual or entity or misrepresent your identity or your affiliation with another individual or entity; (viii) use the Site in an illegal manner or for any unlawful purpose; or (ix) violate any applicable Guidelines, including without limitation any Code of Conduct.

Simunomics does not control and is not responsible for the content of such third-party websites or the conduct of the operators of such third-party websites, and does not make any representations regarding the accuracy, copyright or other statutory or regulatory compliance, legality or decency of any of the content or other materials on such third-party websites. Simunomics encourages you to exercise discretion while browsing the Internet and the Site. If you decide to access linked third-party websites, you do so at your own risk.

Indemnity

You agree to indemnify, defend at your cost and hold harmless Simunomics, its affiliates, subsidiaries, parent companies, and contractors, and each of their current and former officers, directors, employees, agents, licensors, licensees and representatives from and against any losses, liabilities, expenses, claims, damages and costs of any nature, including reasonable attorneys' fees, arising out of or relating to any User Content you post, store or otherwise transmit on or through the Site or your use or inability to use the Site, including without limitation any actual or threatened suit, demand or claim made against the indemnified parties arising out of or relating to your User Content, your conduct, your violation of these Terms of Use, or your violation of the rights of any third party.

Feedback

You acknowledge and agree that any materials, including but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, original or creative materials or other information, provided by you in the form of email or other submissions to Simunomics in response to a request for such materials ("Feedback") are non-confidential and shall become the sole property of Simunomics. Simunomics shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of such Feedback for any purpose, commercial or otherwise, without acknowledgment or compensation to you. You agree to execute any and all documents that Simunomics may reasonably request in connection with confirming Simunomics' ownership of and unlimited right to use such Feedback.

Service Interruptions

Simunomics reserves the right to interrupt any and all service with or without prior notice for any reason or no reason. You agree that Simunomics will not be liable for any interruption of the service, delay, or failure to perform and you understand that you shall not be entitled to any refunds of fees for interruption of service or failure to perform. Simunomics has the right at any time for any reason or no reason to change and/or eliminate any aspect(s) of this service as it sees fit in its sole discretion.

Disclaimers; Limitation on Liability

Because of the variety of possible sources of site content, and the inherent hazards and uncertainties of electronic distribution, there may be delays, omissions, or inaccuracies in such cite content. Moreover, cite content may include facts, views, opinions, and recommendations of individuals and entities other than Simunomics. In no event shall Simunomics’ total liability to you from all damages, losses, and causes of action (whether in contract, tort or otherwise) exceed the amount you paid to Simunomics, if any, for products or services in connection with the site.

Applicable law may not allow the exclusion of implied warranties, or the above limitations of liability, so the above exclusions may not apply to you.
